Blue Line Sports II - NEW Decision 01.29.2025

Decision and Order of Judge Ellis, NYS Supreme Court, Franklin County, issued January 29, 2025 in favor of Petitioners Blue Line Sports and Woods & Waters to defeat the State’s motion to dismiss. The State now has 30 days to answer the petition, or, to file a notice of appeal.

The Decision and Order fills a gap in precedent under NY CPLR 2304 by distinguishing between filing “thereafter” to quash an extra-judicial subpoena versus filing “promptly” to quash a litigation subpoena. The ruling is not limited to NYS-licensed “Dealers in Firearms,” such as petitioners.

This is the second ruling concerning these petitioners. The prior ruling in Blue Line Sports I issued October 7, 2024, is an interesting companion read for those studying NY CPLR 2304 motions to quash subpoenas.
