Gazzola v. Hochul is the lead civil rights case fought by FFL state-licensed “Dealers in Firearms” against the 2022 compliance mandates of NY General Business Law 875 and selected components of the “Concealed Carry Improvements Act.” This is the first ruling by the Second Circuit in the Gazzola case, in response to plaintiffs’ motion for emergency temporary relief. Although no preliminary injunction was granted, the Second Circuit did find the Dealers have standing to sue on behalf of their customers. This important ruling has already been adopted by June 2025 in more than a dozen other jurisdictions, and represents a critical advance in the defense of individual Second Amendment rights.
